TERMS AND CONDITIONS APPLICABLE TO ΤΗE WORLDBRIDGE-PAYMENT INSTITUTION S.A. SERVICE IN COOPERATION WITH WESTERN UNION® (“SERVICE”)

The Service is offered by Worldbridge-Payment Institution S.A., with trading name Paylink (“Company”) in cooperation with Western Union Financial Services, Inc., an American company (for money transfers from the USA, Canada and Mexico and commercial services transactions) and Western Union International Limited, an Irish company (for all other transactions) (together “Western Union”).

Company is a Greek company with registered offices at 11, Menekratous Street, Athens p.c. 11636, licensed and registered at the Bank of Greece, which is the supervising authority. Definitions ( capitalized words used in the present document have the following meaning )

Sender or Customer : the natural person who shall register electronically via the Webpage to use the Service.

Webpage: the webpage https://www.paylink.gr/ & https://www.e-paylink.com/ owned and managed by Company where the Service is provided.

Terms and Conditions: the present terms and conditions for rendering the Service.

Receiver : The receiver of a remittance as defined by the Sender.

Service: sending a money transfer order via the Webpagehttps://www.paylink.gr/ & https://www.e-paylink.com/ in cooperation with the international network of Western Union.

MTCN : For each money transfer which is completed and sent for payment to the Receiver a unique money transfer code number is issued.

Western Union : Western Union Financial Services Inc., and/or Western Union International Limited, as well as any other company of the group of companies that take part in the money transfer business worldwide.

Transaction Fees: The fees Company charges for rendering the Service to the Customer.

CUSTOMER REGISTRATION You must be of majority age to use the Service, register at our Website as Customer and have an e-mail account. You also have to read and accept the Terms & Conditions which govern or relationship. To register for the Service you must provide us or send us using the ways we describe below your identity details and provide us some personal data information. You hereby explicitly declare that the information you provide us each time is true, accurate and full. You also undertake to inform us in case of any future change.

PASSWORD AND SECURITY During registration select a password and declare the e-mail address which will allow you to enter your account for the Service. You are liable and undertake to keep the password and the access to your e-mail account confidential and you are fully responsible for all actions that take place via your e-mail account or with the use of your password you use for the Services. You are responsible to notify us immediately about any unauthorized use of your password or e-mail account you use to enter into your account or for any other violation of their security. As soon as you inform us about the unauthorized use of the password or your e-mail account we shall immediately take measures to prevent their use. Provided we take these measures, Company does not bear any responsibility for loss or damage which derives from your non-compliance with the present obligation. If you pay the money transfer with a bank card which has been unlawfully used, you may have the right for a refund from the card issuer.

MONEY TRANSFER ORDER Sender gives the money transfer order to Company when Sender completes all necessary information for the Service and pays the amount to be transferred plus transaction fees using one of the available on the Webpage payment options.

Before confirming the money transfer, you will be informed about the maximum execution time, the commission charged and the exchange rate applied to the transaction, via the same channel as the one used to place the money transfer.

You consent to pay the fees for the Service or for any other transaction you initiate via the Services. There are different payment methods available on the Webpage to pay for the money transfer (by credit/debit card, go CASH, by depositing money on a bank account). Every time you use the Service you agree that you are authorized to charge the card issuer for the amount of the money transfer plus fees for the Service prior to executing the money transfer order. The exact amount we shall charge your card issuer shall be notified to you before you give Company your final approval for the transaction.

MTCN After completing all necessary information and paying for the money transfer and fees, that is after the total amount has been debited to Company’s account and provided all controls have been made by the Company’s system the MTCN is provided to the Customer. The Customer undertakes to inform the Receiver about the money transfer. Regular money transfers are usually paid in cash, however some Agents may offer of the Receiver may chose alternative ways of payment such as to an account or mobile phone. The Sender authorizes Company and Western Union to satisfy the Receiver’s choice even if this differs from the payout method the Sender selected.

RECEIVING MONEY - For the time being this Service is available for receiving money via the Webpage.

Funds will be available for collection by the receiver at the latest by the end of the business day that follows the day on which the send amount and transaction fees were received by Company and Western Union or its Agent (“Date of Receipt”), subject to statutory and regulatory requirements. For money transfers issued in paper form, this deadline is extended for one more business day. For (i) money transfers occurring outside of the EEA or (ii) for money transfers in which there is more than one currency conversion between the euro and the currency of one of the non-eurozone member states of the European Union or EEA occurs or (iii) for a possible cross border money transfer which does not occur in euro, funds will be available for collection by the receiver at the latest by the end of the fourth business day following the Date of Receipt.

Regular money transfers are usually available for pick up within minutes, unless the “Next Day” or “2 Day” Service is chosen when funds will be available for collection by the receiver after 24 and 48 hours respectively from the time the money is sent. Funds may be delayed or Services unavailable based on certain transaction conditions, including amount sent, destination country, currency availability, regulatory issues, identification requirements, Agent location hours, differences in time zones, or selection of delayed options. Additional restrictions may apply.

Conditions of payment and liability - Payment shall be made to the person that Company and Western Union deem entitled to receive it after examination of identification documents. The payment can be made only when the recipient has given the transaction details required by Company and Western Union, in particular the sum of money transferred the name of the sender the country from which the money was sent as well as the MTCN. Furthermore the recipient must identify him/herself appropriately.

Company and Western Union will have fulfilled their obligation to you as soon as the transferred sum of money has been paid out to a person who has quoted the above mentioned transaction details and identified him/herself appropriately through an identification document and/or a test question if applicable as the recipient named by you. Company and Western Union shall examine the transaction details quoted by the recipient and the identification document produced with appropriate care and will refuse payment should there be justification to doubt the authenticity of said identification document.

You are obliged to ensure the correctness, completeness and legibility of the information you provide. Furthermore you must take care to ensure that persons other than the recipient do not gain knowledge of data related to the transfer, such as e.g. you or your recipient’s name, the MTCN or the amount of money transferred. Company and Western Union recommend transferring sums of money only to persons you know. Company and Western Union do not accept any guarantee for the supply or the properties of goods or services which were paid using the Service.

If you believe your transaction details have been stolen, lost or copied contact us details below immediately. Prior to reporting such a loss, theft or improper use to Western Union you shall only be held liable if (i) you have forwarded transaction details to persons other than the recipient, which contributed to the improper use or (ii) did not immediately communicate the loss, theft or improper use or (iii) acted with intent to defraud, willfully or with gross negligence.

Company and Western Union shall be held liable for damages resulting from the intentional misconduct or from the gross negligent conduct of its employees while processing your transaction pursuant to applicable law. Company and Western Union’s liability, the liability of its affiliated companies and of its foreign Agents is excluded in cases of minor negligence. The liability of Company and Western Union is limited to the refund of the typically foreseeable damage of the contract up to the maximum amount of EUR 500 (in addition to the amount transferred and any charges). In no event shall Company and Western Union be liable if you have willfully or negligently disclosed data related to the transfer to persons other than the recipient. Company and Western Union shall not be held liable for damage caused by Force Majeure, the breakdown of telecommunication lines, civil unrest, war or other events which are outside Company and Western Union’s influence (e.g. strike, industrial lock-out or orders issued by government authorities).

Where Company and Western Union or its Agents accept a cheque, credit or debit card or other non-cash forms of payment, neither Company nor Western Union or its Agents is obliged to process the money transfer or pay it out, if the payment cannot be cashed. Furthermore, neither Company nor Western Union or its Agents shall be liable for damage caused by a non-payment to a receiver due to the collection by Company or Western Union or its Agents of non-cash form of payment or caused by the fact that the money transfer has been effected only when Company and Western Union or its Agents have been able to cash the particular payment. Company and Western Union or its Agents may refuse to provide the Service to any person, without giving a reason, in particular to prevent fraud, money laundering or terrorist financing or to comply with any applicable law, order of a court or requirement of any regulatory or government authority.

TRANSFER FEES - Written information explaining the fee charged for the Service the Sender shall pay for making a money transfer via the Webpage are available on the Webpage and appear to the Sender before and after the completion of the details for the money transfer. Sender pays all fees. Unless applicable law in the destination country requires otherwise, the Sender will bear all fees for the money transfer. In certain cases, payment of a money transfer may be subject to local taxes and service charges.

Money transfer payments will normally be made in the currency of the destination country (in some countries payment is available only in an alternate currency). The exchange rate may be an estimate only, and the actual exchange rate will be determined at the time the money transfer is confirmed in the system. All currency is converted at Western Union’s then current rate of exchange. Western Union calculates its rate of exchange based on commercially available interbank rates plus a margin. Company and Western Union and its Agents may make money from currency exchange. Most rates of exchange are adjusted several times daily in line with the prevailing rate of financial markets globally. To the extent allowed by law, Western Union may deduct an administrative charge from money transfers that are not picked up within one year of the date of receipt.

The receiver may incur additional fees for receiving the sender’s funds through a mobile telephone or to an account. The receiver’s agreement with its mobile phone service, mWallet or other account provider governs the account and determines their rights, liability, fees, funds availability and account limitations. In the event of an inconsistency between the account or mobile number and name of the receiver, the transfer will be credited to the account number provided by the sender. Western Union accepts no responsibility to the sender nor to any account holder for any fees, exchange rates used for conversion to non-local currency, acts or omissions of the destination or intermediary financial service providers. Should sender or receiver request SMS notification to indicate availability or payout of the funds, charges applied by the service provider are the exclusive responsibility of the sender or receiver.

SMS - Western Union offers free SMS notification in some countries to indicate to the sender that the transaction has been collected by the receiver or to the receiver that funds are available for collection. Western union is not responsible for any charges payable by the sender or receiver associated with SMS messages.

OUR RESPONSIBILITY TO YOU Company takes all measures to ensure safe and quick Customer support. We accept your messages as reliable and true and being sent from the Customer who has been registered as user on our Webpage, unless we receive a notification from you that the message is forged or coming from a person who has not been authorized by you.

Further, we inform you that WE ARE NOT RESPONSIBLE:

- The delivery or suitability of products or services you attempt to buy from the internet and pay using the Service nor do we guarantee for their receipt or suitability.

- For malfunctions of the telecommunication services, which are not subject to our control and can affect the accuracy or promptness of the messages you sent us or any losses or delays in the transmission of messages which are due to the use of any service providing access to the internet or which are caused by the browser or other software beyond our control. Viruses which are spread by others, defects of the application caused by defected or wrong information.

- For services your card issuer provides you.

- For defects in the Service caused by insufficient or wrong information we receive from you or third parties.

- For any unauthorized use or monitoring of the information you send to us before it reaches Company.

Company shall not initiate or perform the Service or any other service if:

(a) we have not received sufficient evidence about your identity and you do not reply to the information asked.

(b) we believe that the message you sent us is wrong or forged or not authorized by you.

(c) Western Union does not execute the money transfer.

(d) if your card issuer does not approve its use for payment of the Service.

(e) if you do not pay in advance the amount to be transferred plus transaction fees using one of the payment options we provide you.

In these cases Company bears no responsibility to execute your order or for damages caused to you from this refusal to render the Services and non payment of the money to the Receiver or failure to complete the transaction.

REFUSAL TO RENDER SERVICE / DELAY IN EXECUTION . We may refuse to render the Service (as a whole or partially) if in this case we would violate any applicable law, court order resolution of any regulatory, governmental authority under whose jurisdiction we are subject to or if we consider this action necessary for the protection of our interests. However, if we refuse to render the Service (as a whole or partially) for any of the aforementioned reasons, we will inform you about this refusal, if possible, unless there is a legal impediment we will explain to you the reasons of our refusal.

We may suspend the operation of the Webpage or the Service totally or partially if at our absolute discretion we deem it appropriate due to conditions out of our control. We undertake that in case the Service is suspended or interrupted (either by us or by any third service provider or any other way) for any reason whatsoever, to take all necessary measures to minimize the duration of the interruption. Provided we have complied with this undertaking we are no longer liable to you for any loss or damage you may have because of this interruption, even if caused by our negligence, except in cases where such interruption is caused by our fraud.

Applicable law prohibits money transmitters from doing business with certain individuals and countries; Company and Western Union are required to screen all transactions against lists of names provided by the governments of the countries and territories in which we do business, including the US Treasury Department’s Office of Foreign Assets Control (OFAC) and the European Union. If a potential match is identified, Western Union and Company researches the transaction to determine if the name matched is the individual on the relevant list. On occasion, customers are required to provide additional identification and other information, delaying transactions. This is a legal requirement for all transactions processed by the Agent and Western Union (inclusive of transfers that originate and terminate outside of the US). We may also deny rendering Services to anyone without explaining the reasons in order to avoid fraud, or to prevent money laundering and terrorist financing or in order to comply with any legislation, court order or request from any regulatory or governmental authority.

REFUND AND ADMINISTRATIVE CHARGES You have the right to annul this agreement with us any time after you accept the Terms and Conditions, subject to the terms of this paragraph within a time frame of 14 days starting from the next day of acceptance of the Terms and Conditions. You can annul the agreement by communicating with Company using one of the methods mentioned at the end of the present text. In case you have not used the Service we will not charge you with any cancellation fee.

If you have already used the Service Company shall reimburse the amount of the money transfer order according to the process mentioned below, provided the Receiver has not already received the money before you ask us for cancellation.

Once cancelled, Company and Western Union will refund the principal amount, deducting the transfer fee applied for the Service. Refunds typically take up to 10 business days. You may request a refund of the principal amount of a money transfer by writing to Company by letter or email if payment to the receiver is not made within 45 days. Company or Western Union will refund the transfer fee upon your written request to Company by letter or email if the money transfer is not available to the receiver within the timelines specified above, subject to delay not being due to conditions beyond the control of Company, Western Union (or the Agents), such as regulatory requirements, inclement weather or telecommunications failure. Payment of some money transfers may be delayed as a result of the application of United States or other applicable laws.

INTELLECTUAL PROPERTY RIGHTS The Service may only be used for purposes described in the Terms and Conditions. You are entitled to read and maintain a copy of the pages of this Webpage only for your personal use. You are not entitled to copy, publish, amend, create derivative works from, to participate in the transfer or sale, to post on the world wide web or in any other way distribute or make use of he Webpage or any part of it for public or commercial use without our written and explicit consent. You do not have the right to: (a) use web robots, spiders, scrapers or any other automated program to connect with the Webpage and/or (b) to remove or alter any notification or notice about the registration of intellectual property, trade mark, which appears on the Webpage (or on printed pages of the Webpage). Company’s trade name, as well as Western Union’s name and all other names and signs of ownership of Company and Western Union and/or the Services which are mentioned either belongs exclusively to us of to third parties. Other product, service or company names appearing on the Webpage may belong to their owners..

LINKS - The Website you are visiting may offer access to web pages of third parties through appropriate links. These links have been placed merely for your convenience and the web sites they connect you with are governed by the terms and conditions of those web sites. Placing such links on our Website does not imply approval or acceptance of their content of those web pages by Company. Company bears no responsibility whatsoever for their content, their data protection practices or the accuracy of the contents. Should you decide to link with such a web page you accept that you do so at your own risk.

DATA PROTECTION- Your personal information is processed under applicable law and controlled by Company and Western Union.

Information we collect about you: When you use our digital or retail services, contact us or join our loyalty programmes, we collect personal information about you (as set out on this form/our online application forms) and may use it along with other information collected or generated during our relationship with you. We collect your contact information, information about your money transfers, bill payments, membership in our loyalty programmes, previous use of our services and marketing choices. When you use our digital or on-line services, we collect personal information about the domain and host from which you access the Internet, your computer's IP address or device advertising ID, browser and operating system software, the date and time you access our websites and the address of the site from which you linked to our website when you visit us. To conduct a money transfer, you must provide the information required on the relevant form you complete to execute the transfer and to enable us to comply with our legal obligations associated with transferring money. If you fail to provide the required personal information, you will not be permitted to conduct a money transfer with us. In addition to the personal information we collect from you, we also collect your personal information from the person to whom you send and/or from whom you receive money, as well as our agents, service providers, business partners, identity verification companies, payments and fraud risk management companies, law enforcement bodies and commercial and public data sources.

We use your information for the following purposes and on the following lawful bases:

Providing our services to you: This includes using personal information necessary for conducting money transfers and delivering other products and services to you as required under our contracts with you.

Legal and compliance purposes: This includes using your personal information to comply with legal and regulatory duties such as anti-money laundering and counter-terrorist financing. This includes using your personal data to validate and authenticate your identity and utilising third parties to help us do so.

Legitimate business purposes: We use your personal information to analyse and improve the quality, speed and efficiency of our products, locations, services, support and operations, to perform administrative tasks necessary to provide our services, and to help manage risks related to security, fraud and identity, including detection, prevention and prosecution of fraud and theft as well as preventing illegitimate or prohibited use of our services. We conduct analysis of the information we hold to better understand our customers and our customers' transactions, including analytics to help us customise our marketing, to tailor our products and services to help us anticipate your needs and requirements, and to administer our loyalty programme.

Where we have your permission: Where you have consented to our use of your personal information for a particular purpose or activities. Subject to your choices under applicable law and based on the contact information you provide, we will send you marketing communications and offers by email, telephone, post, SMS, social media and other communication channels.

We may disclose your personal information: If there is a reasonable need to do so for any of the purposes listed above, we disclose your personal information to the following types of organisations or parties: Western Union group companies: our agents or business partners who facilitate the specific service or money transfer transaction you have requested; service providers, payments processors, banking partners and data processors contracted to provide business and customer services including customer satisfaction research on our behalf; service providers and data processors contracted to help us validate the accuracy of the information provided by you, and to authenticate your identity and manage risks related to security, fraud and identity. We also disclose your personal information globally, as required or permitted by applicable laws and regulations to regulatory and financial authorities, law enforcement bodies, courts, governments or government agencies, to meet compliance and legal obligations or to defend the rights and interests of Western Union or others.

International transfer: We transfer your information to parties in countries outside the European Economic Area (EEA), including but not limited to the USA as required by applicable law, regulatory authorities, law enforcement and government agencies. Additionally, when you send or receive money to or from another country, we will also be required to share some of your personal information with that country as required or permitted by law. We transfer certain personal information about you to our data centres in the USA and process it to fulfil our legal and compliance obligations which apply to the services we provide. We also store certain personal information we collect based on your marketing choices in our US data centre. When your personal information is transferred to or accessed from the USA or another country outside the EEA for which the European Commission has not issued an adequacy decision, it will be protected by appropriate contractual clauses or other EU-approved mechanisms, as required by law. Retention of personal information: Your personal information will be retained in accordance with statutory periods contained in regulations applicable to financial transactions including those in anti-money laundering, anti-terrorist financing and other laws applicable to us. Otherwise, we will retain your information only as long as necessary for the specific purposes it was collected, to resolve any query you may raise, or as long as we need to retain it in order to protect or defend our legal position.

Your rights: You have the right to know if we are processing your personal information and to ask us for a copy of your information free of charge. You have the right to request a structured and machine-readable copy of certain information you have provided to us for purposes to which you have consented or where our use is required for a contract with you. We may charge you a reasonable fee for providing the information, or not act upon your request, if the request is manifestly unfounded or excessive. You have the right to stop us sending you marketing communications. You have the right to ask us to correct information about you that is incomplete, inaccurate or out-of-date. You have the right in some circumstances to ask us to erase certain information about you, to restrict certain uses of your information, and also, where our use is for legitimate business purposes, to object to certain uses of it. TERMINATION Each contracting party has the right to terminate this agreement at any time by informing the other party about it and the agreement shall be terminated the next day after the notification. The notification is addressed to the other party using one of the communication options mentioned at the end of this agreement, but its receipt from the receiving party must be proved by the sending party. Termination does not entitle the parties to seek damages due to the termination but pending transactions shall be executed and governed by the Terms and Conditions.

ENTIRE AGREEMENT The Terms and Conditions together with all other matters incorporated into them by reference, embody the entire agreement and understanding between you and us and supersede and terminate all prior agreements and understandings you may have with us.

AMENDMENT The Terms and Conditions shall be amended from time to time. You shall be informed about these amendments by us through our Webpage. The amendments shall have effect from the date of uploading on the Webpage. No amendment we make limits your right to terminate this agreement between us in the manner described below.

TRANSFER We have the right to transfer, assign or delegate our rights and/or responsibilities on whole or in part under our agreement with you to an affiliated company or any third party at any time without your consent unless such transfer would reduce your rights and/or remedies or increase your responsibilities and/or liabilities under this agreement. You may not transfer your rights and/or responsibilities under your agreement with us without our prior written consent.

GOVERNING LAW . This contract is governed by Greek Law, as well as the consumer’s legislation of the country where you perform the transaction and the Courts of Athens are competent to solve any dispute arising out of or due to the present agreement or the court the consumer’s legislation applicable determines as ex lege competent.

In the event you have a complaint , believe an error has been made or have an enquiry in relation to the Service, please contact customer services [info at the end of the form]. We will investigate your request and provide you with regular updates on its progress. An acknowledgement of your complaint will be sent to you within 5 business days of the complaint being received. The acknowledgement will contain the date of receipt plus a reference number, which should be used in all further communications with Company. If you are dissatisfied with the resolution proposed by Company, you have the right to refer your complaint at the respective governmental authority in the country where you have performed the transaction.
